Terms of sale

1. Who we are

These terms apply to every order placed on babyprintlab.nl, babyprintlab.de and babyprintlab.fr (together "the shop"). The seller is:

2. Who can order

The shop sells to consumers: people buying for purposes outside their trade, business, craft or profession. We deliver only to addresses in the 27 member states of the European Union.

3. Our products are made for you

Every product in the shop is printed to order with the personal details you enter, such as your baby's name, date and time of birth, weight and length, together with the style and colour you choose. Nothing is printed before you order it; each item is made for you.

4. How an order is placed

  1. You enter your details in the editor and see a live preview.
  2. On the proof page you check the design and approve it by typing your baby's name again and confirming that you have checked the details.
  3. In the basket you check the products, quantities and total price. Until you pay, you can go back and correct any entry.
  4. You press the order button ("Buy now") and pay on the payment page of our payment provider Stripe.

The contract is concluded when your payment is confirmed. We then send you an order confirmation by email. Contracts are concluded in the language of the shop you order from (Dutch, German, French or English). We do not keep the contract text available for you after the order; please keep the confirmation email and save or print these terms.

5. Your responsibility for the approved proof

We print exactly the text and choices you approved on the proof. Please check spelling, names, dates, times, weights and lengths carefully before you approve. An error in what you entered and approved is not a defect in the product.

Orders are sent to production automatically shortly after payment, so we cannot promise to change or cancel an order once you have paid. If you notice a mistake, contact us as soon as possible at contact@babyprintlab.nl.

The on-screen preview shows your design as closely as a screen allows. Small differences in colour and paper texture that are normal in printing are not a defect.

6. No right of withdrawal

You have no right of withdrawal for products from this shop. Under Article 16(c) of Directive 2011/83/EU on consumer rights, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Every product in the shop is printed with the personal details you provide (section 3), so this exception applies from the moment the contract is concluded. The same exception is laid down in article 6:230p(f) of the Dutch Civil Code, § 312g(2) no. 1 of the German Civil Code (BGB) and article L221-28 3° of the French Consumer Code.

This does not affect your rights if a product is faulty or damaged (section 9).

7. Prices and payment

All prices are in euros and include VAT and shipping. The price that applies is the price shown in the basket when you order. You pay in advance through Stripe, with one of the payment methods shown on the payment page. Stripe processes the payment; we do not receive your card details. The order confirmation email contains a link to your invoice when it is available; if it does not, ask us for your invoice at contact@babyprintlab.nl.

If we cannot carry out an order after payment, for example because the print partner cannot produce it or because of an obvious price error, we will let you know and refund the full amount you paid.

8. Production and delivery

Your order is printed by our print partner and shipped to the address you enter at checkout. Delivery dates shown in the shop are estimates. We deliver without undue delay and at the latest within 30 days after the contract is concluded, unless we agree otherwise with you. If we do not deliver in time, you have the rights the law gives you.

The risk of loss or damage passes to you when you, or someone you name other than the carrier, receive the goods. Please make sure the delivery address you enter is correct and complete.

9. Faulty, damaged or wrong products

You have the statutory legal guarantee of conformity under the law applicable to you (for goods sold in the European Union at least two years from delivery, Directive (EU) 2019/771). If a product is faulty, damaged in transit, lost, or not what you ordered and approved, we will reprint it or, where the law allows or requires it, reduce the price or refund you, in accordance with the law.

Please report a problem by email to contact@babyprintlab.nl as soon as you can after you discover it, with your order number and, where possible, photos of the product and packaging. This helps us resolve it quickly; it does not shorten your statutory rights. If we ask you to return a product, we bear the cost of the return.

Consumers residing in France also have the legal guarantee of conformity under articles L217-1 to L217-32 of the French Consumer Code and the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, as set out in the statutory notice in the French version of these terms (babyprintlab.fr).

To reprint an order we need the details you entered. We delete these some time after delivery (see the privacy policy), so we may ask you to provide them again.

10. Liability

We are liable in accordance with the statutory rules. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law.

11. Personal data

We process your personal data as described in our privacy policy on this site.

12. Complaints and disputes

Send complaints to contact@babyprintlab.nl. We aim to resolve every complaint with you directly.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board in Germany.

13. Applicable law and courts

These terms and every contract concluded under them are governed by Dutch law. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence. You may bring a claim before the courts of your country of residence or before the competent Dutch court.

14. Changes to these terms

The terms that apply to an order are the terms published in the shop when you placed it. Changes apply only to orders placed after they take effect.
